Terms of Sale

These Terms of Sale ("Terms") are entered into between ARCHIREF (Société par actions simplifiée unipersonnelle (SASU), share capital of 2 000 €, RCS Paris 790 929 921, intra-Community VAT number FR25 790929921, registered office at 68 rue Mstislav-Rostropovitch, 75017 Paris, France), operating this site under the trade name "Future Architecture", SIRET 790 929 921 00027, registered training organisation n° 11757422475, hereinafter "we", and any individual or legal entity subscribing to or purchasing a product or service on this site, hereinafter the "Customer".

1. Scope

These Terms apply to all sales made on this site, including SuperArchi subscription plans and any digital packs, resources, training or coaching sessions offered on the site. They apply to the exclusion of any other terms, including any that may appear in the Customer's own documents, unless we expressly agree otherwise in writing.

2. Subscription plans and services

SuperArchi is offered mainly as a subscription service, billed on a recurring basis (monthly or annual, as selected at checkout). Each plan is described on its pricing page: features included, usage limits, and billing frequency. We reserve the right to change our plans, features and pricing at any time; the terms applicable to a subscription are those in effect when it is first taken out, subject to Article 4 for changes on renewal.

3. Price, billing and payment

Prices are shown in euros, all taxes included, unless stated otherwise. Payment is processed by our payment provider (Stripe), using the payment method provided at checkout, which is automatically charged at the start of each billing period until the subscription is cancelled.

4. Confirmation, trial period and renewal

The subscription is confirmed once payment is authorised by our payment provider. A confirmation email is sent to the Customer, summarising the subscription and restating the acknowledgements given at checkout (see Article 6). Where a free trial is offered, this is stated clearly at checkout together with the date the paid subscription begins; the Customer may cancel at any time during the trial to avoid being charged.

Subscriptions renew automatically at the end of each billing period for the same duration, at the then-current price, unless cancelled beforehand in accordance with Article 7. We will notify the Customer by email in advance of any price increase before it takes effect on renewal.

5. Intellectual property

All content made available (the SuperArchi platform, training, videos, documents, templates, packs and any other resource) remains the property of ARCHIREF or its licensors and is protected by intellectual property law. The access granted to the Customer constitutes a personal, non-exclusive, non-transferable right of use for their own purposes, for the duration of their subscription. Any reproduction, resale, distribution or communication to the public of this content, in whole or in part, without prior written authorisation, is prohibited.

6. Right of withdrawal

This article applies only to Customers who qualify as consumers under French law, i.e. individuals subscribing for purposes outside their trade, business or profession. If the Customer is a professional subscribing for purposes related to their trade, business or profession, this right of withdrawal does not apply.

Under article L221-18 of the French Consumer Code (Code de la consommation), consumers generally have a 14-day period from the date of their first subscription order to exercise their right of withdrawal. This period applies only to the initial subscription order and does not reopen at each renewal.

However, under article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for digital content or services not supplied on a tangible medium once performance has begun, provided the Customer has given prior express consent to receive immediate access to the service and has expressly acknowledged that they thereby lose their right of withdrawal. This consent is collected at checkout, before the order is confirmed, via a checkbox separate from acceptance of these Terms. Proof of this consent (timestamp and content of the acknowledgement) is retained and restated in the order confirmation email.

7. Cancellation and refunds

The Customer may cancel their subscription at any time from their account settings or by contacting us; cancellation takes effect at the end of the current billing period, and access remains available until then. Outside the cases of exercising the right of withdrawal described in Article 6, and subject to applicable statutory guarantees, amounts already paid for a billing period are final once access has been granted, and we do not provide partial refunds for unused time. 8. Liability

We do our utmost to provide a reliable service. Our liability is limited to direct and foreseeable damages resulting from a breach of our obligations, and cannot exceed the amount paid by the Customer for the subscription or service concerned over the 12 months preceding the event giving rise to liability.

9. Personal data

Personal data collected as part of a subscription or order is processed in accordance with our Privacy Policy.

10. Governing law

These Terms are governed by French law. Failing an amicable resolution, disputes will be brought before the competent French courts.
